California courts allow for certain eligible defendants to complete special treatments and educational courses in place of jail time. At present there are three common pre-trial diversion programs:
- Drug Diversion (PC 1000)
- Mental Health Diversion (PC 1001.36)
- Military Diversion (PC 1001.81)
Upon successful completion of the diversion program, the case is typically dismissed and the records are sealed. On the other hand, if the defendant does not complete the program the state will continue with the prosecution. Diversions are an excellent opportunity for the defendant to get back “on track” and get the help they need while avoiding long jail sentences.
